General Terms and Conditions (GTC) of BE SADE GmbH
Scope
The following General Terms and Conditions (GTC) govern the contractual relationship between BE SADE GmbH (hereinafter referred to as "Seller") and you as the customer when you purchase goods via the Seller's online shop (hereinafter referred to as "Customer").
Contractual Partner
The purchase contract is concluded with BE SADE GmbH, represented by the managing directors Derya Eskin, Sarra Zubari, and Önder Zubari [Commercial Register HRB 105945 at the Local Court of Darmstadt].
Offer and Conclusion of Contract
3.1 The presentation of products in the online shop is not a legally binding offer, but an invitation to place an order. By clicking the "order with obligation to pay" button, you place a binding order for the goods contained in the shopping cart.
3.2 Upon receipt of the order, the Seller will send you an automatic order confirmation by email. This order confirmation does not constitute acceptance of the offer but merely informs you that the order has been received.
3.3 The contract is only concluded when the Seller dispatches the ordered goods to you and confirms the shipment to you with a second email (shipping confirmation).
Prices and Payment Conditions
4.1 The prices indicated in the online shop are in Euro, inclusive of statutory VAT, and excluding shipping costs.
4.2 Payment can be made by credit card, SOFORT, PayPal, and Klarna. You select the desired payment method during the ordering process.
4.3 If you choose the payment method "SOFORT," the payment processing is carried out by the payment service provider SOFORT GmbH. You must have an online banking account enabled for SOFORT participation, verify yourself accordingly, and confirm the payment instruction to SOFORT. The payment transaction is processed immediately by SOFORT, and your bank account will be debited.
4.4 If you choose the payment method "PayPal," the payment will be processed via PayPal. PayPal may also use third-party services. PayPal conducts a credit check based on the customer data provided. The Seller reserves the right to refuse the chosen payment method in case of a negative credit check result. Upon approval of the chosen payment method, you must settle the invoice amount within 14 days.
4.5 If you choose the payment method "Klarna," the payment processing is handled by Klarna Bank AB, located at Sveavägen 46, 111 34 Stockholm, Sweden. In this case, we ask for your consent to transmit the data required for payment processing, as well as for identity and credit checks, to Klarna. Klarna's privacy policy applies to identity and credit checks in Germany. You have the option to revoke your consent to the use of your personal data for these purposes at any time with Klarna.
Delivery and Shipping Costs
5.1 Delivery takes place within 3 to 6 working days after conclusion of the contract.
5.2 Shipping costs are free within Germany. You bear the costs for returns yourself. Please fill out the delivery note for returns. If no delivery note has been sent, we ask you to informally write down the order number and the reason.
We also offer express shipping (1-2 working days) for €10.
For deliveries abroad, shipping costs amount to €4.90.
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day:
- on which you or a third party designated by you, who is not the carrier, takes possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered uniformly;
- on which you or a third party designated by you, who is not the carrier, takes possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately;
- on which you or a third party designated by you, who is not the carrier, takes possession of the last partial shipment or the last piece, provided that you have ordered goods that are delivered in several partial shipments or pieces.
To exercise your right of withdrawal, you must inform us, BE SADE GmbH, Lorscher Str. 26, 68519 Viernheim, info@be-sade.com, by means of a clear statement (e.g., a letter sent by post or email).
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse you all payments we have received from you, including delivery costs (except for the additional costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we receive the notification of your withdrawal from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You must send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Reservation of Title
The delivered goods remain the property of the Seller until full payment has been made.
Warranty
Statutory warranty provisions apply.
Data Protection
The privacy policy can be viewed on the website of BE SADE GmbH and governs the handling of personal data.
Applicable Law and Jurisdiction
German law applies. The place of jurisdiction for all disputes arising from this contract is the registered office of BE SADE GmbH, provided that you are a merchant within the meaning of the German Commercial Code, a legal entity under public law, or a special fund under public law.
Final Provisions
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a provision shall apply which comes closest to the economic purpose of the invalid provision.
